CONDITIONS OF THE TRAVEL CARD SCHEME MANAGED BY WM CARD SYSTEMS

DEFINITIONS

In these conditions "Photocard" means a card bearing:

  • A photograph of the person to whom it was issued
  • The name and address (and in the case of a child, the date of the 16th birthday)of the person to whom it was issued
  • A serial number

In these conditions "Season Ticket" means a ticket bearing:

  • The expiry date
  • A serial number
  • A number which is the same as that on the Photocard in respect of which the Season Ticket was issued

In these conditions the "Wallet" means the wallet issued by West Midlands Travel Ltd to holders of Travel Cards and which is designed to hold a Photocard and a Season Ticket.

In these conditions "Travel Card" relates to a combination of Photocard, Season Ticket and Wallet.

In these conditions, reference to "Travel Card" includes pre-paid tickets purchased off the bus issued by West Midlands Travel Ltd, including n-bus tickets, except where otherwise specified.

In these conditions, except where the context otherwise requires, the expression "West MidlandsTravel Ltd" includes subsidiary companies.

CONDITIONS

A Photocard is not valid unless it is accompanied in the Wallet by a then current Season Ticket bearing the number of the Photocard in the space provided.

A Season Ticket is not valid unless it is accompanied in the Wallet by a Photocard the number of which appears on the Season Ticket in the space provided.

A Travel Card may not be used for travel other than by the person whose photograph, name, address and date of 16th birthday (where applicable) appear thereon.

A person holding a current and valid Travel Card is entitled to travel without making any additional payment on the following services:

  • TWM TRAVELCARDS
    Bus services operated by West Midlands Travel Ltd subject to any exemptions contained in the conditions relating to specific tickets or separately advertised, and the exemptions detailed in the schedule to these conditions.
  • n-bus TICKETS
    Bus services operated by West Midlands Travel Ltd and by other operators participating in the n-bus Ticket Scheme within the County of West Midlands only, subject to any exemptions contained in the conditions relating to specific tickets as separately advertised, and the exemptions detailed in the schedule to these conditions.

Possession of a Travel Card does not give the holder thereof any rights or privileges in addition to those enjoyed by all other passengers and in particular without limitation does not give any right to board vehicles in advance of other passengers or to a seat on such vehicles.

The person travelling or intending to travel using a Travel Card is subject to the terms of the Acts governing the carriage of passengers on public service vehicles and to the regulations applicable to such passengers, and to the conditions of carriage of the bus operator (West Midlands Travel Ltd for WM Travelcards, a participating operator for n-bus tickets).

Child Travel Cards are for persons:

  • Under 16 years of age, the Photocard must show date of 16th birthday, the Season Ticket must commence prior to date of 16th birthday.

From 16 years of age to end of the Academic Year in which the 18th birthday falls (after 1st September), a 16-18 Photocard application form must be obtained from schools/colleges, the Season Ticket must commence prior to the expiry date of the Photocard.

Travel Cards remain the property of West Midlands Travel Ltd at all times and may be withdrawn from the holder or the person in possession thereof at any time in the event of a breach or suspected breach of these conditions, or the conditions of issue.

Travel Cards should always be kept in the Wallet provided for that purpose and must be shown:

  • On boarding to the Driver of any West Midlands Travel Ltd bus or, in the case of n-bus tickets, a participating operator's bus.
  • On demand to any Driver, Inspector or Official of West Midlands Travel Ltd, or in the case of n-bus tickets, to any driver, Inspector or Official of a participating operator.

Season Tickets can be purchased or renewed from Agents who are using new Season Ticket issuing point of sale equipment on any day of the week including Saturdays and Sundays (subject to Agents opening hours). The Season Tickets can be used for the exact number of days for which they are valid from / to.

Where an Agent is not utilising new Season Ticket issuing point of sale equipment then Season Tickets can be purchased by new applicants on the Friday and Saturday prior to, and on the Sunday of the ticket's due date of commencement, and on Monday and Tuesday following.

Currently valid Season Tickets can be renewed on the Thursday, Friday and Saturday prior to, and on the Sunday of the ticket's due date of commencement.

In the case of a renewal on a Thursday, the purchaser must surrender their current ticket at the time of purchase and this must be of a similar type to the ticket renewed (ie; Off-peak renewed for Off-peak, Area renewed for Area, Regional renewed for Regional).

For tickets purchased after the date of commencement a purchaser agrees to forfeit the proceeding day or days of use. Refunds are given only in exceptional circumstances and at the discretion of West Midlands Travel Ltd.

Season Tickets are not replaced on loss, or in the event of their being stolen, destroyed or other circumstances unless they are Annual Tickets or covered by a Season Ticket replacement scheme. Replacement Season Tickets are given at the discretion of West Midlands Travel Ltd will be validated to expire on the same date as the original ticket, and will be subject to an administration charge.

Any person using a Travel Card after the date of expiry of the Season Ticket to obtain travel on a West Midlands Travel Ltd bus or, in the case of n-bus tickets, a participating operator's bus will be liable to :

  • Pay to West Midlands Travel Ltd liquidated damages at the daily rate for the period commencing on the day following the said date of expiry and terminating on the date upon which he or she was found to be so using the Travel Card.
  • Pay any standard fare charged on the bus for the journey in respect of which he or she is using the out of date Season Ticket.
  • Prosecution for obtaining pecuniary advantage by deception contrary to Section 16 of the Theft Act 1968 and/or using a ticket which has expired contrary to Regulation 7(1) of The Public Service Vehicles (Conduct of Drivers, Inspectors, Conductors and Passengers) Regulations 1990.
